Refund Policy

This Refund Policy explains how Montana Coders handles project cancellations, refunds, milestone payments, third-party costs, billing reviews, and payment-related disputes for digital services and software projects.

Refund Policy Overview

At Montana Coders LLC, we provide professional digital services including website development, mobile applications, UI/UX design, branding, AI solutions, ecommerce systems, cloud services, software engineering, SEO, and digital marketing. Since our services involve planning, research, creative strategy, technical architecture, development resources, and dedicated team allocation, refunds are reviewed based on the project stage, completed work, approved milestones, and agreed service terms.

Eligibility for Refunds

Clients may request a partial or full refund if Montana Coders fails to deliver the agreed services within the committed timeline and the delay is not caused by missing client feedback, unavailable content, approval delays, third-party issues, or incomplete project requirements. Refund eligibility is reviewed according to completed work, allocated resources, and active project progress.

Initial Payments and Deposits

Initial project payments, onboarding fees, consultation charges, discovery sessions, planning work, business analysis, competitor research, architecture planning, and resource reservation costs are non-refundable. These payments cover operational expenses incurred at the start of the engagement.

Milestone Based Payments

Payments associated with completed, delivered, reviewed, or approved milestones are non-refundable. Once a milestone has been shared with the client or approved through feedback, the related payment becomes final.

Cancellation Before Work Begins

If a project cancellation request is submitted before work officially begins and before resources are allocated, Montana Coders may review the request for a partial refund after deducting administrative costs, payment processing fees, consultation time, and preparation work already completed.

Cancellation After Work Begins

Once project work has started, refunds may no longer apply. Clients requesting cancellation after project initiation may still be responsible for completed work, development hours, meetings, planning, communication, resource allocation, and any third-party expenses already incurred by Montana Coders.

Client Delays and Non Responsiveness

Clients may not qualify for refunds if project delays are caused by failure to provide content, assets, credentials, approvals, technical requirements, feedback, or communication within a reasonable timeframe. If a client remains inactive or unresponsive for more than 14 to 20 business days, the project may be paused and refund eligibility may become void.

Change of Mind

Refunds are not applicable if the client changes their mind, pauses the business idea, changes partners, chooses another agency, changes branding direction, closes the business, or decides to discontinue the project after work has started.

Design and Development Work

Refunds are not available for completed UI/UX designs, branding concepts, logo concepts, prototypes, wireframes, source code, backend systems, APIs, integrations, mobile applications, websites, dashboards, ecommerce systems, cloud configurations, deployment work, or any deliverable already shared with the client.

Website and Application Approvals

For websites and applications, refunds will not be entertained once the design, interface, architecture, or functionality has been approved by the client and the project has entered the development or deployment stage.

Marketing and SEO Services

SEO, ASO, social media marketing, paid advertising, Google Ads, email marketing, and other digital marketing services are based on strategy, optimization, execution, and market conditions. Montana Coders does not guarantee rankings, leads, revenue, downloads, or conversion outcomes. Completed marketing work and ad spend are non-refundable.

Third Party Services and Purchases

Payments made for domains, hosting, APIs, SSL certificates, plugins, app store accounts, cloud services, stock assets, paid subscriptions, AI model usage, payment gateways, themes, software licenses, or any external service are non-refundable once purchased, activated, configured, or utilized.

Third Party Disputes

Refund eligibility may become void if Montana Coders receives legal complaints, disputes, claims, intellectual property concerns, trademark conflicts, or third-party objections related to the client’s project, content, business model, or provided materials.

App Store and Deployment Requirements

Clients are responsible for providing required Google Play Console accounts, Apple Developer accounts, business verification documents, hosting access, and deployment credentials on time. Delays caused by missing deployment requirements may impact project timelines and do not qualify for refunds.

Monthly Installment Contracts

Projects running on installment plans or monthly contracts are considered fixed-price commitments rather than cancel-anytime subscriptions. Monthly installments reserve dedicated technical resources, developers, designers, and project management capacity exclusively for the client throughout the agreed project duration.

Dedicated Resource Allocation

Once a billing cycle begins, dedicated development capacity and technical resources are considered reserved and operational for the client. As a result, installments may be treated as consumed once the billing cycle starts, regardless of whether all allocated hours are utilized by the client.

Temporary Billing Pause

If Montana Coders fails to provide a meaningful project update, technical progress, or development activity for more than 14 business days without valid justification, the client may request a temporary billing review or billing pause until the project is actively progressing again.

Ownership and Intellectual Property

Ownership of finalized source code, applications, designs, and deliverables transfers to the client only after all outstanding invoices, milestone payments, subscriptions, and contractual obligations have been fully cleared. Montana Coders retains ownership rights over unpaid work, rejected concepts, internal frameworks, reusable systems, and proprietary tools.

License Revocation

In cases involving payment default, fraudulent disputes, chargebacks, unauthorized usage, or violation of contractual terms, Montana Coders reserves the right to revoke licenses, suspend services, restrict usage rights, or disable access to unpaid deliverables where legally permitted.

Refund Review Process

All refund requests must be submitted in writing with complete project details, payment references, supporting information, and the reason for the request. Montana Coders may request additional documentation before processing the review. Refund investigations may take up to 15 business days depending on project complexity and payment verification.

Refund Calculation

Approved refunds are calculated proportionally based on completed work, approved milestones, consumed hours, project planning, consultation time, dedicated resources, third-party purchases, and operational costs incurred up to the refund request date.

Chargebacks and Payment Disputes

Clients are encouraged to contact Montana Coders directly before initiating disputes or chargebacks through payment providers. Fraudulent disputes filed after receiving consultation, designs, development work, source files, or services may result in suspension of access, legal recovery actions, or termination of future collaboration.

Non Refundable Services

The following services are generally non-refundable once initiated or delivered: branding work, SEO services, social media marketing, hosting, domain registration, paid advertising, AI integrations, API subscriptions, stock assets, copyright registrations, trademarks, app deployment services, software licenses, maintenance plans, and third-party purchases.

Project Rights After Refund

If a refund or dispute is processed, all rejected concepts, unfinished work, draft designs, source files, strategies, development materials, and associated intellectual property may remain the sole property of Montana Coders. Clients may not reuse refunded work without written authorization.

Dispute Resolution

Both parties agree to first attempt resolving disputes professionally through direct communication and negotiation. Montana Coders reserves the right to pursue legal remedies, collections, arbitration, or contract enforcement where necessary under applicable laws and jurisdictions.

Montana Coders reserves the right to update or modify this Refund Policy at any time to reflect operational, legal, technical, or service-related changes. Updated policies will be published on this page with the latest revision date.
