Acceptance of Terms

By accessing our website, requesting a quote, booking a consultation, submitting a form, or using any service provided by Montana Coders, you agree to comply with these Terms of Service. If you disagree with any part of these terms, you should discontinue the use of our website and services.

Use of Our Website

Users agree to use our website responsibly and lawfully. You may not misuse our platform, attempt unauthorized access, distribute malicious code, copy protected content, interfere with website functionality, or use our services for fraudulent, illegal, or harmful activities.

Project Discovery and Consultation

Before beginning a project, Montana Coders may conduct discovery sessions, technical consultations, planning meetings, research, workflow analysis, competitor evaluations, architecture discussions, and proposal preparation to better understand project requirements, goals, and business expectations.

Service Scope and Deliverables

All services are delivered according to the agreed proposal, statement of work, quotation, contract, milestone structure, or approved project scope. Any additional feature requests, integrations, revisions, redesigns, or scope modifications may require additional time, resources, and pricing adjustments.

Client Responsibilities

Clients are responsible for providing complete project requirements, accurate information, approvals, content, brand assets, access credentials, third-party permissions, technical resources, and timely feedback necessary for project completion. Delays caused by missing client communication or assets may impact timelines and delivery schedules.

Communication and Approvals

Project approvals, feedback, revisions, confirmations, and communication provided through official Montana Coders communication channels including email, project management systems, meetings, or messaging platforms may be treated as valid project instructions and approvals.

Payments and Billing

All projects follow the agreed pricing structure, invoice schedule, milestone plan, subscription agreement, or payment terms discussed before project initiation. Work may pause if invoices, subscriptions, installments, or milestone payments are delayed beyond the agreed due dates.

Dedicated Resources and Installment Contracts

Projects operating under monthly retainers, installment plans, or dedicated resource models reserve developers, designers, engineers, strategists, or technical teams exclusively for the client. These contracts are considered committed service engagements and not cancel-anytime monthly subscriptions.

Revisions and Change Requests

Montana Coders provides revisions according to the approved project scope or selected package. Significant changes, repeated redesigns, functionality changes, or requests outside the original scope may be treated as additional work and may require revised timelines and additional costs.

Project Timelines

Estimated timelines are based on project complexity, approvals, third-party dependencies, and client responsiveness. Montana Coders is not responsible for delays caused by client inactivity, platform approvals, hosting issues, API limitations, app store reviews, force majeure events, or external service interruptions.

Third Party Platforms and Services

Projects may rely on third-party providers including hosting companies, cloud platforms, payment gateways, APIs, app stores, analytics providers, plugins, software licenses, domains, AI services, or advertising platforms. Montana Coders is not liable for outages, policy changes, pricing updates, account restrictions, suspensions, or failures caused by third-party providers.

App Store and Deployment Requirements

Clients are responsible for providing active Google Play Console accounts, Apple Developer accounts, hosting credentials, domain access, cloud access, and other deployment requirements necessary for project launch and publishing.

Ownership and Intellectual Property

Ownership of finalized deliverables including approved source code, applications, designs, websites, and project assets may transfer to the client after all invoices and outstanding balances are paid in full. Montana Coders retains ownership rights over rejected concepts, reusable systems, internal frameworks, libraries, automation systems, proprietary tools, development methodologies, and pre-existing intellectual property.

License and Usage Rights

Clients are granted rights to use finalized approved deliverables according to the agreed project purpose. Unauthorized resale, redistribution, reverse engineering, or misuse of proprietary Montana Coders frameworks, templates, systems, or confidential deliverables is prohibited unless approved in writing.

Confidential Information and NDA

Montana Coders respects the confidentiality of client projects, business information, credentials, internal documentation, intellectual property, and strategic materials. Upon request, we may enter into a Non-Disclosure Agreement before discussing sensitive business information.

Data and Security

We apply commercially reasonable measures to protect project data, credentials, and client information. However, no online platform, hosting provider, cloud environment, or communication system can guarantee absolute security. Clients are encouraged to avoid sharing unnecessary sensitive information.

Support and Maintenance

Post-launch maintenance, updates, bug fixes, monitoring, server support, optimization, and technical assistance are provided according to the agreed support plan or maintenance contract. Additional features or major upgrades may require separate agreements and pricing.

SEO and Marketing Disclaimer

Montana Coders does not guarantee specific search rankings, app downloads, traffic volume, leads, conversions, or revenue results from SEO, ASO, paid advertising, social media marketing, or digital marketing services. Marketing outcomes depend on competition, algorithms, budgets, audience behavior, and market conditions.

Limitation of Liability

Montana Coders shall not be liable for indirect losses, lost revenue, lost profits, business interruption, data loss, cyberattacks, hosting failures, API outages, app store rejections, search engine changes, platform suspensions, or damages resulting from misuse of delivered work or third-party service failures.

Suspension or Termination of Services

Montana Coders reserves the right to suspend, reject, limit, or terminate services in cases involving abusive behavior, payment defaults, fraudulent disputes, intellectual property violations, misuse of services, policy violations, unlawful activity, or breach of agreement terms.

Force Majeure

Montana Coders is not responsible for delays or service interruptions caused by events outside reasonable control including internet failures, hosting outages, cyber incidents, natural disasters, labor shortages, governmental restrictions, third-party platform downtime, or unforeseen technical circumstances.
